1. Acceptance of Terms
By accessing or using BidBull ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. We may modify these Terms at any time, and your continued use constitutes acceptance of the modified Terms.
2. Eligibility
To use BidBull, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Platform under applicable laws
- Complete identity verification as required
Accounts registered by automated means or on behalf of another person without authorization are prohibited.
3. Account Registration
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.
4. Bidding and Purchasing
Binding Bids: All bids are legally binding offers to purchase. By placing a bid, you agree to pay the bid amount if you win.
Payment: When you win (or buy now), you and the seller exchange contact details and arrange payment and handover. Failure to complete the transaction may result in account restrictions.
Pricing: Your total is the winning bid plus any shipping (if the seller ships). No platform fees at launch.
Bid Retraction: Bids may only be retracted in exceptional circumstances (e.g., clear typographical errors) and must be requested within 1 hour of placement.
5. Selling
Sellers agree to:
- Provide accurate and complete item descriptions
- Include clear, genuine photographs of the actual item
- Disclose all known defects, damage, or issues
- Ship items within 7 days of receiving payment
- Pack items securely and appropriately
- Honor all successful auction results
Seller Fees: No platform fees at launch. You and the buyer arrange payment between yourselves.
6. Prohibited Items and Conduct
Prohibited Items:
- Counterfeit, replica, or unauthorized goods
- Stolen property or items with unclear provenance
- Weapons, explosives, and hazardous materials
- Illegal drugs and controlled substances
- Items that infringe intellectual property rights
- Adult content and services
- Live animals and protected wildlife products
Prohibited Conduct:
- Shill bidding (bidding on your own items or colluding with others)
- Bid manipulation or interference
- Circumventing the platform (off-platform transactions)
- Harassment or threatening behavior
- Providing false information
- Creating multiple accounts
7. Payments and Handover
Buyers and sellers arrange payment and handover between themselves (e.g. cash on pickup, bank transfer). When you win:
- You and the seller exchange contact details and agree on payment method and handover (ship or pickup).
- The seller ships with tracking (if applicable) or arranges pickup. You confirm delivery when you receive the item.
- Mark the order complete when handover is done. Contact support if you need help resolving an issue.
We do not hold or process payments at launch. Both parties are responsible for completing the transaction in good faith.
8. Disputes and Resolution
We encourage buyers and sellers to resolve issues directly. If unable to reach agreement, our support team will review the case and make a binding decision based on:
- Listing description and photographs
- Communication between parties
- Evidence provided (photos, tracking, etc.)
- Platform policies and precedent
Both parties agree to accept the decision of our support team as final for amounts under $10,000. Larger matters may be escalated to arbitration.
9. Intellectual Property
BidBull and its content, features, and functionality are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our permission.
By posting content on the Platform, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with our services.
10. Limitation of Liability
BidBull is a platform connecting buyers and sellers. We are not a party to transactions and do not guarantee:
- The accuracy of listings or seller representations
- The quality, safety, or legality of items
- The ability of sellers to complete sales
- The ability of buyers to complete purchases
To the maximum extent permitted by law, BidBull shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
11. Indemnification
You agree to indemnify and hold harmless BidBull, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Your content posted on the Platform
12. Governing Law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Dubai, UAE, unless otherwise agreed in writing.
For users in other jurisdictions, local consumer protection laws may provide additional rights that cannot be waived.
